El día 25 de febrero, delegaciones del secular partido Fatah y de Hamás, acrónimo en árabe del Movimiento de Resistencia Islámica, mantuvieron reuniones preliminares en El Cairo, para eliminar obstáculos al acercamiento. Los negociadores describieron la instancia como "positiva".

"Esperamos que esta reunión sea el comienzo de un nuevo periodo en el que se ponga fin a una división perpetuada demasiado tiempo", dijo a la prensa el jefe de la inteligencia egipcia, Omar Suleiman, a cargo del vínculo entre el gobierno de Hosni Mubarak y los palestinos.

Según la prensa estatal egipcia, cada grupo accedió a liberar a los miembros del otro detenidos en la franja de Gaza, en manos de Hamás, y en Cisjordania, controlada por Fatah.

Como gesto de buena voluntad, Fatah liberó a 42 integrantes de Hamás prisioneros en Cisjordania, y prometió concretar pronto otras liberaciones.

El día 26 de febrero, las conversaciones en El Cairo se ampliaron para incluir a otros 10 grupos palestinos, además de Fatah y Hamás. Junto con la formación de un gobierno de unidad nacional, el debate se refirió a las próximas elecciones presidenciales y legislativas, la reestructuración de los aparatos de seguridad y el rol de Hamás en la Organización para la Liberación de Palestina (OLP).

Los detalles sobre esa reunión, que se realizó a puertas cerradas, son vagos, pero Suleiman enfatizó la importancia de llegar a un acuerdo aceptable para ambas partes.

Essam Al-Arian, dirigente del partido opositor egipcio Hermandad Musulmana, dijo que "Hamás está dispuesto a compartir un gobierno de unidad con Fatah y a aceptar una presencia de la ANP en el cruce de Rafah". Ese cruce es el único punto de tránsito en los 14 kilómetros de frontera entre Egipto y Gaza.

No obstante, persisten diferencias fundamentales entre los dos partidos, particularmente respecto de Israel. Hamás sigue una política de resistencia armada contra ese país, y se niega a reconocer la legitimidad del Estado judío.

Junto con las conversaciones interpalestinas, Hamás participa en negociaciones indirectas para un cese del fuego con Israel, también con mediación egipcia.

En contraste, Fatah mantiene una estrategia de negociación directa con Israel.

Los mediadores egipcios esperan cerrar un acuerdo entre Fatah y Hamás sobre los términos de un gobierno de unidad nacional a tiempo para su aprobación en una cumbre árabe programada para fines de marzo...

The conference "Freedom from Nuclear Weapons - Through Legal Accountability and Good Faith" took place on 6-7 July 2006 in the European Parliament in Brussels. It marked the tenth anniversary of the International Court of Justice (ICJ) Advisory Opinion on the legality of the threat or use of nuclear weapons. In this Opinion, the Court, unanimously decided that "the threat or use of nuclear weapons would generally be contrary to the rules of international law applicable in armed conflict, and in particular the principles and rules of humanitarian law".

This Conference was organised by the International Physicians for the Prevention of Nuclear War, Abolition 2000 Europe, the International Association of Lawyers Against Nuclear Arms and the International Peace Bureau. It was sponsored by MEPs Gisela Kallenbach and Caroline Lucas on behalf of the Green/EFA Group in the European Parliament.

Radio Nizkor has interviewed Benjamin Ferencz on a number of issues which concern the developments and current situation with regard to international law. Benjamin Ferencz is a former Nuremberg Prosecutor and a peace advocate. He is Adjunct Professor of International Law at Pace University and founder of the Pace Peace Center.

We have asked Benjamin Ferencz to tell us about the following:

  • His indictment in the Einsatzgruppen case and the "criminal organization" nature of these extermination units.
  • His analysis on the current situation surrounding the Internacional Criminal Court.
  • About the supreme crime of all international crimes, that is to say, the crime of aggression.
  • The US performance of going into war in Iraq leaving aside the UN.
  • The problems arising from the deterioration of civil liberties after 9/11, specially in the US.
  • Torture in Iraq.

During the seminar on "States of Exception and Strategies for Peace and for the Defence of Civil Rights", held in Brussels between the 27th. and the 29th. of March 2003, Richard Wilson- Professor of Law and Director of the International Human Rights Law Clinic, American University Washington, D.C.- took the opportunity to interview Rey Claro Casambre about the Filipino Peace Negociations Model.

The importance of this interview relies on the fact that there is a lack of concrete information about the Filipino peace process. Also, in these peace negotiations International Human Rights Law and International Humanitarian Law are clearly used, which promotes a better comprehension of the important role of these two elements in any peace negotiation process.

This speech by Prof. Richard Wilson was delivered at the seminar on "States of Exception and Strategies for Peace and for the Defence of Civil Rights", organized by Equipo Nizkor and held in Brussels between the 27th. and the 29th. of March 2003.

Richard Wilson analyses the "legal black hole" surrounding the status of the Guantanamo detainees, as well as the question of precautionary measures that the Inter-American Commission on Human Rights has asked the US government to adopt.

The Commission decided during its 114th regular period of sessions to adopt precautionary measures on behalf of the Guantanamo detainees. The Commission asserted that:

    "....where persons find themselves within the authority and control of a state and where a circumstance of armed conflict may be involved, their fundamental rights may be determined in part by reference to international humanitarian law as well as international human rights law. Where it may be considered that the protections of international humanitarian law do not apply, however, such persons remain the beneficiaries at least of the non-derogable protections under international human rights law. In short, no person under the authority and control of a state, regardless of his or her circumstances, is devoid of legal protection for his or her fundamental and non-derogable human rights".

What is this "Legal Black Hole" and what is the executive branch's theory as to why these individuals are caught there?

"The US applies a perverse logic to conclude that all the individuals detained in Guantamo are 'unlawful combatants' ".

This is what Richard Wilson clearly explains us.
