US intervenes in the revision of the EU data protection Directive / The proposed EU-US PNR agreement breaches data protection and due process. "According to a spokesperson at the European Commission, the publication of the proposal for the review of the EU Data Protection Directive has been postponed until late February or March 2012..." European Digital Rights (EDRi) informs that "right at the end of the inter-service consultation process in the European Commission, the United States Department of Commerce launched a significant lobbying campaign against the leaked draft proposal for a Data Protection Regulation. In general, the US complained about the draft proposal arguing that it will break with international standards and might even end up being counterproductive for data protection". According to EDRi, "Most of the objections are rather specious, obviously weak or plain wrong and interest-driven, aiming to water down the standards in the leaked draft Regulation. Also, on 17 November 2011, U.S. and EU officials initialled a proposed agreement to authorize airlines to forward Passenger Name Record (PNR) data to the U.S. Department of Homeland Security (DHS). Although the agreement cannot take effect without the approval of the European Parliament (EP) and the Council, the Members of the European Parliament (MEPs) could read the proposed agreement only in a sealed room where they could not take notes or make copies. The complete text on which the EP will vote has finally been made public, revealing a failure to address the concerns raised by the Parliament and continued shortfalls in data protection, due process, and protection of fundamental rights... Kain explains that "The proof that this bill does not expressly exempt U.S. citizens or those captured on U.S. soil is that amendments offered by Sen. Feinstein providing expressly for those exemptions were rejected. The 'compromise' was to preserve the status quo by including the provision that the bill is not intended to alter it with regard to American citizens, but that's because proponents of broad detention powers are confident that the status quo already permits such detention... En un comunicado de 15 y 22nov11, la Asamblea del Pueblo Guaraní Itika Guasu (APG IG) denunciaba una "campaña incitada por el Ministerio de Hidrocarburos (MHE) y Medio Ambiente y por la empresa estatal YPFB Transporte S.A. (ex Transredes SA) con la intención de intimidar y coercionar socialmente a la APG IG con una interpretación racista y que tiene la intención de conminar a nuestra organización a 'autorizar' la licencia ambiental del gasoducto Expansión Gasoducto Villa Montes-Tarija Fase II. Esta campaña ignora que ha sido el propio MHE el que ha ordenado a las empresas Petrobras SA y Transredes SA no negociar con nuestra organización, extremos estos documentados legalmente... Update on the issues of Net Neutrality and Data Retention in the EU. This program shows the current state of the debate on what is known as "net neutrality" and the discussion points at a EU level based on the October 7th, 2011 Opinion of the European Data Protection Supervisor (EDPS). Net neutrality refers to the issue of whether Internet service providers (ISPs) should be allowed to monitor network traffic to filter or restrict Internet access or give preference access to others... As the European Parliament enters in the final stage of the negotiations on its resolution on Net neutrality, this opinion underlines that the EU Commission's "wait and see" approach is bound to fail and is unjustifiable. A second program provides with an update on mandatory data retention. The EU Data Retention Directive requires ISPs to keep communications data concerning: phone-calls, faxes, mobile phone calls (including location) and internet usage. Because of the highly invasive nature of the surveillance and monitoring permitted by mandatory data retention the directive was annulled or suspended by court decisions in several Member States. Given the differences between Member States on this matter, it remains to be seen whether the original Directive will be amended or repealed... Prominent academics and activists say one of the main pending challenges in Honduras is a resumption of the demilitarisation of the country and the strengthening of civilian control over defence policy that was brought to an abrupt halt by the June 2009 coup d'état. A number of academics and civil society organisations are drafting proposed constitutional reforms aimed at eliminating the military tutelage enshrined in the constitution and at bringing about changes in society's relations with the military. One of the cornerstones of the proposals for change is closer monitoring of the defence budget to improve accountability. The role played by the military in "democracy-building processes" should be reviewed and the armed forces must lose their veto power...
